Welcome to Annabelle Hale Photography. By booking our photography services, purchasing products, or accessing and using our website, you agree to be bound by the following terms and conditions. Please read them carefully.

1. Copyright and Ownership

All photographs, images, and other materials created by Annabelle Hale Photography are the exclusive property of Annabelle Hale Photography. As the copyright holder, we retain all rights to the images, including but not limited to the rights of reproduction, distribution, and display. No image may be copied, reproduced, edited, published, transmitted, or uploaded in any way without our prior written consent.

2. Usage Rights and Licensing

Upon full payment of the agreed fee, we grant the client a non-exclusive, non-transferable license to use the photographs for personal or commercial purposes as agreed upon in the contract. This license does not include the right to sell or distribute the images to third parties.

We reserve the right to use the photographs taken during any assignment for marketing, portfolio, advertising, and promotional purposes on our website, social media, or other platforms unless specifically agreed otherwise in writing prior to the session.

3. Booking and Payment Terms

To secure a booking, a non-refundable deposit of 50% is required at the time of booking. The remaining balance must be paid in full before any photographs are released to the client. Failure to make full payment will result in a delay in the delivery of images and may result in cancellation of services.

4. Delivery of Photographs

Final edited images will be delivered within 2 weeks of the shoot date unless otherwise agreed upon. Delivery will be made via a secure online gallery, download link, or other agreed method. We are not liable for any delays caused by factors beyond our control.

5. Cancellation and Rescheduling Policy

If a client needs to cancel or reschedule a session, they must provide at least 7 days notice. Cancellations made with less than the required notice period will forfeit the deposit. Rescheduling is subject to availability and must be agreed upon by both parties.

6. Model Release

By booking our services, the client agrees to grant Annabelle Hale Photography the right to use photographs of any individuals captured during the session for promotional, advertising, and portfolio purposes unless otherwise specified in writing. If a model release is required, it must be signed before the start of the session.

7. Limitation of Liability

While we take every precaution to ensure the safety of our equipment, data, and client images, Annabelle Hale Photography cannot be held responsible for unforeseen technical issues, equipment failure, or acts of God that may result in the loss of photographs or delays in delivery. Our liability is limited to the return of all payments received for the session.

8. Image Editing and Retouching

All delivered images will be edited and retouched according to our professional standards. Any additional editing requests may incur an extra fee, which will be agreed upon before any additional work is undertaken.

9. Client Responsibilities

Clients are responsible for ensuring that all relevant parties involved in a photoshoot (such as models, makeup artists, and stylists) are aware of these terms and conditions. The client must also ensure that all necessary permits and permissions for the shoot location are obtained.

10. Amendments

Annabelle Hale Photography reserves the right to amend these terms and conditions at any time without prior notice. The most current version will always be available on our website.

By booking a session with Annabelle Hale Photography, you acknowledge that you have read, understood, and agreed to these terms and conditions.
